David Toups focuses his practice in probate, trust, guardianship, and business litigation with an emphasis on breach of trust or fiduciary litigation. He also advises and counsels individuals, financial service firms, and financial service professionals regarding financial planning and litigation matters. David’s experience spans over 21 years in the financial services industry.
David holds the professional designations of Chartered Financial Analyst (CFA); Certified Financial Planner (CFP); and Certified Trust & Financial Advisor (CTFA). He is also an honor graduate of Cannon Financial Institute’s Trust School.
Prior to establishing his own firm, David practiced complex commercial, estate, trust, probate, and guardianship litigation in Houston, Texas. Before becoming an attorney, David consulted on and managed estate, trust, and retirement portfolios for a state and two national bank trust divisions. While serving in this capacity, he chaired the review committee charged with evaluating and approving marketable security holdings for the national bank’s Texas discretionary accounts. During his career, David has been a registered investment advisor, a registered representative for two national brokerage firms, and served as an officer in the U.S. Marine Corps.
David received his undergraduate degree in business from Texas A&M University. He received his Master of Business Administration (MBA) from Sam Houston State University, where he was inducted as a member of the Beta Gamma Sigma business honor society.
David graduated with honors (cum laude) from South Texas College of Law in Houston, where he represented South Texas as a varsity trial advocate, was a member of Phi Delta Phi, and received the Order of the Lytae. While at South Texas, he interned for both the Court of Appeals for the First Supreme Judicial District of Texas and the First Statutory Probate Court of Harris County.
David is licensed to practice before the U.S. Supreme Court, the United States Court of Appeals for the Fifth Circuit; the United States District Court for the Southern District of Texas; the Supreme Court of Texas, and all lower courts of Texas. David is a member of the Real Property, Trust & Probate and Litigation Practice Sections of the Texas Bar Association; and the Association for Investment Management & Research. David is also certified to act as attorney ad litem in Texas guardianships.
David has been married 19 years and is the father of a 18-year-old son and 14-year-old daughter.
